Was the banishment of Romeo fair or unfair?

Was the banishment of Rome fair or unfair?

I believe that Romeo's punishment was fair, because instead of death he got banishment from the city. Being banished, he can still see Juliet. If he was dead, there would be no way for him to see Juliet. Romeo was only banished because he killed Tybalt, who murdered Mercutio after trying to pick a fight with Romeo. Mercutio was simply standing up for Romeo, because he didn't believe in fighting. After killing Tybalt, Romeo realized that he had done what Tybalt had wanted all along. "O,I am fortune's fool"-Shakespeare,ACT III SCENE 1 LINE 132.Therefore, Romeos actions have proven to be fair. Juliet and Romeo may or may not see each other, thus proving that it is  the ultimate punishment, never being able to see his lover ever again.
