Romeo Innocent or Guilty?

Romeos punishment is not fair because Tyblit killed merqutio so he acted out of anger. “These violent delights have violent ends.” I think when the prince banished Romeo  he should of known that Romeo only killed Tyblit because he killed merqutio which is the princes kinsmen. Tyblit was also asking to be killed when he returned after he ran away.
